Richie Sambora was arrested for DUI and is now staring down the barrel of charges for child endangerment since he brilliantly decided to drive drunk with his 10-year-old daughter Ava in the car. Also in the car was another minor and an unidentified woman. Scope out Heather Locklear’s response when notified of the arrest, according to TMZ:

And, police sources say, after Sambora was busted, the cops called Heather Locklear, Ava’s mom. We’re told Heather authorized the woman in the car to drive her daughter home.

Britney Spears’ lawyer filed a request today to be withdrawn from the ongoing custody battle between Britney and Kevin Federline. TMZ reports:

In the legal papers, attorney Tara Scott from Trope and Trope wrote, “There has been a breakdown in communications between [Britney] and Trope and Trope making further representation of her interests impossible.”
Sources tell TMZ the reason Trope and Trope withdrew is because Britney just didn’t listen to her lawyers’ advice, and her behavior was generally sinking her case.

Britney Spears also failed to show up again for a deposition hearing today which prompted her lawyer’s request to withdraw:

As one connected source put it, “Her whole life has become insane and it’s impossible for anyone to get through to her.”

Mischa Barton got herself arrested this morning for DUI and was released from jail around 10 a.m. TMZ reports:

According to a press release issued by the L.A. County Sheriff’s Department, the former “O.C.” star was pulled over early this morning around 2:45 AM as she was driving in West Hollywood, Calif. Cops say she “was seen straddling two lanes of traffic and failed to signal when making a turn.” When deputies pulled her over, they determined that she “was an unlicensed driver and was driving while under the influence of an alcoholic beverage.”

R&B singer Brandy has yet to be charged with vehicular manslaughter from her December 2006 crash that left a woman dead. Apparently, the delay is because authorities have evidence that conclude Brandy may not have been the one at fault. The California Highway Patrol shared some of this information with TMZ that puts the situation in a new light:

A CHP source tells TMZ the woman who died in the car accident involving Brandy actually struck the vehicle in front of her before Brandy made any contact. The law enforcement source says Awatef Aboudihaj, the woman who died, struck the car in front of her — which was going 65 mph, and then slammed on her brakes. We’re told the sudden stop caused Brandy to hit the dead woman’s car.

TMZ has confirmed that “American Idol” trainwreck finalist Jessica Sierra done got herself knocked up — and she’s still in the slammer! Don’t throw the baby out with the bathwater!

Sources tell TMZ that the father is a “rapper” and Jessica is ecstatic over the news. She’s currently in the infirmary in the Falkenburg Road Jail in Florida on a “pregnancy diet.” Jessica’s spawn has a lifetime of fun to look forward to — look, it’s mommy in a sex tape!

Sierra is currently facing two misdemeanor charges of disorderly intoxication and obstructing or opposing an officer and two felony counts of possession of cocaine and battery.

9. Game
Compton-bred rapper the Game was collared in mid-May in Los Angeles and booked on suspicion of making criminal threats. The arrest, according to police, was connected to an incident that went down three months prior, amid a pickup basketball game. The rapper was accused of brandishing a weapon during the game, which he used to threaten one of the other players. He was later released on $50,000 bail.

8. Nick Bollea
Last month, the 17-year-old son of wrestler Hulk Hogan turned himself in to police and was arrested on charges of reckless driving for his role in an August crash in Florida that left his passenger, 22-year-old John Graziano, in critical condition. Graziano sustained a broken skull and has been in a coma ever since the accident. Bollea is currently awaiting trial and denies any wrongdoing.

7. Tony Yayo
Back in March, Yayo was arrested on charges of harassment and endangering the welfare of a child in New York, for allegedly slapping the 14-year-old son of the Game’s manager, Jimmy Rosemond. He’s currently awaiting trial.

6. Lindsay Lohan
Following a stint in rehab, Lohan was arrested in late May for driving under the influence of alcohol after losing control of her Mercedes-Benz convertible and ramming a curb. Police found a small amount of cocaine inside the mangled sports car, and she was right back in rehab. Then, in late July, Lohan was arrested again after being in a bizarre car chase. Lohan refused to take a breathalyzer test, but failed several other field-sobriety tests, and police also found a small amount of cocaine on her. She faced a handful of charges but wound up serving only 84 minutes in jail for her offenses.

5. Lil Wayne
In July, the rapper’s first major gig in New York was followed with a trip to the clink, following Wayne’s arrest on gun-possession charges. His tour bus was pulled over, and cops searched it, finding a .40 caliber pistol and some marijuana. And then, in October, Wayne was pinched in Boise, Idaho, on a felony fugitive charge issued in Georgia for allegedly possessing a controlled substance.

4. Remy Ma
The female rapper was charged this summer with attempted murder charge following a shooting outside a New York nightclub. She pleaded not guilty to the charge and was released on $250,000 bond but was ordered earlier this week to stand trial on charges of gang assault and witness tampering. Prosecutors argue Remy Ma ordered a group of men to attack the boyfriend of her friend Makeda Barnes-Joseph, who she is accused of shooting in July after a dispute that took place on a New York street.

3. OiNK founder Alan Ellis
The 24-year-old Ellis was arrested on suspicion of conspiracy to defraud and copyright infringement in October as part of an Interpol-led investigation into OiNK, the invite-only file-sharing site he launched three years ago. The site provided illegal downloads of pre-release music and media to its more than 180,000 members before authorities shut it down. Ellis, an IT consultant, operated the site from his apartment in Middlesbrough in the north of England. He dismissed the charges, claiming his site was no different than Google.

2. Kid Rock
Before he was arrested in late October on charges of misdemeanor battery in Georgia for allegedly beating up a man at a Waffle House with his entourage, Rock was arrested for clocking ex-wife Pamela Anderson’s first husband, Mötley Crüe drummer Tommy Lee, during the MTV Video Music Awards in Las Vegas. Rock said a lingering “level of disrespect” between the two provoked the fisticuffs. He was charged by Las Vegas police with misdemeanor battery, but Lee later requested Rock not be charged over the incident.

1. T.I.
In mid-October, the rapper was arrested in Atlanta on charges of buying illegal machine guns, possession of three unregistered machine guns and two silencers, and possession of firearms by a convicted felon. Agents booked T.I. as he allegedly accepted a delivery of three machine guns and two silencers from one of his bodyguards. After posting bail, T.I. was remanded to house arrest, and is not allowed to step out his front door unless he has a medical appointment or court appearance. He is awaiting trial on the gun charges.

Velvet Revolved frontman Scott Weiland has been arrested. Again.

Los Angeles (E! Online) – What does Raymundo Ortega know that the California Highway Patrol doesn’t?

Lindsay Lohan‘s attorneys want the man suing Lohan for negligence in connection with a two-year-old car accident to either show ‘em or fold ‘em.According to court documents filed in Los Angeles Superior Court, Lohan’s camp is requesting that a judge order the Los Angeles-based busboy to provide proof that Lohan, contrary to the CHP’s report, had been drinking on Oct. 4, 2005, before she smacked into Ortega’s van with her Mercedes.

Ortega, who has accused the former child star of knocking a few back at the Ivy before their collision, is seeking at least $200,000 in damages. He filed suit on June 14, also naming the restaurant as a defendant, while Lohan was drying out at the Promises treatment facility in Malibu, her second of three stints in rehab this year.

He maintains that Lohan was not only intoxicated but was also distracted by the shutterbugs trailing her out of the restaurant.

Lohan fired back in a $75,000 countersuit last month, pointing out that the CHP ruled at the time that neither alcohol nor paparazzi factored into the crash and that Ortega was at fault because he was making an illegal U-turn.

The 21-year-old starlet’s lawyers also request in their latest filing that the judge conclude that Ortega’s allegations are false because the plaintiff has ignored their repeated requests to turn over the documents he claims to have that prove his assertions.

Ortega’s lawyer has said that they have witnesses who will support their side of the story.

A hearing on the defense’s motion is set for Jan. 9.

Meanwhile, L.A. Superior Court Judge Michael L. Stern ruled Wednesday that Lohan’s upcoming deposition in the case can be videotaped, despite her lawyers’ objections that doing so could spark a media feeding frenzy if the recording was ever leaked.

“If a single picture of Ms. Lohan can sell for thousands of dollars, a videotape of the deposition will undoubtedly sell for tens of thousands of dollars, or more,” attorney David J. Ozeran argued on her behalf.

Of course, it remains to be seen whether a feature-length film starring Lohan will ever again make more than tens of thousands of dollars at the box office. While Georgia Rule and I Know Who Killed Me didn’t fill many theaters, Lohan will try to recapture the Mean Girls  magic with the upcoming tango-centric romance Dare to Love Me.
